Terms of Service

These terms of service ("Terms of Service") govern your use of Coltcam Properties and its subsidiaries' ("Coltcam Properties") websites, services, applications, and RV park properties (the "Services"). By using or accessing the Services, you agree to be bound by these Terms of Service, as updated from time to time in accordance with Section 12 below. There may be instances when we offer additional terms specific to a product, application or service. To the extent such additional terms conflict with these Terms of Service, the additional terms associated with the product, application or service will prevail. References to "us," "we," and "our" mean Coltcam Properties.

1. Using the Services

Some Services may allow you to:

• Add your own original content or post your content in blog or user comment areas ("Your Content"). Remember that all information disclosed in blog, comment or other public areas becomes public information, and you should exercise caution when deciding to share any of your personal information as part of Your Content.
• Use the Services as modified with Your Content.
• Arrange for third parties to have access to Your Content subject to these Terms of Service.

By submitting Your Content to the Services, you hereby grant Coltcam Properties a worldwide, royalty-free, non-exclusive, sublicenseable and transferable license to use, distribute, reproduce, prepare derivative works of, perform and display Your Content in connection with the Services and Coltcam Properties' business, including without limitation for promoting the Services, in all media now known or hereafter devised. You acknowledge that use of the Services is for your personal use only.

Except as expressly permitted herein, you shall not:

• Access the Services by any means other than instructions provided by Coltcam Properties.
• Use the Services for any illegal or unauthorized purpose.
• Share with any third party any access codes or account information, including without limitation your username and password.
• Upload, post or otherwise distribute content that is unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another's privacy, or otherwise objectionable.
• Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary right of any party.
• Upload content constituting unauthorized advertising, junk email, or any form of lottery or gambling.
• Upload content containing software viruses or any code designed to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment.
• Impersonate any person or entity.

We generally do not pre-screen, monitor, or edit content posted by users. However, we reserve the right at our sole discretion to remove any content that, in our judgment, does not comply with these Terms or is otherwise harmful, objectionable, or inaccurate. You are responsible for all activity that occurs under your account and must notify us immediately of any unauthorized use.

2. Ownership

All rights (including without limitation, copyrights, trademarks, patents and trade secrets) in the Services and the content contained therein, other than Your Content ("Coltcam Properties Content") are and will remain the sole and exclusive property of Coltcam Properties and/or its licensors. No title to or ownership of any portion of the Services, the Coltcam Properties Content, or any other products or services is transferred pursuant to this agreement. Coltcam Properties hereby grants you a limited, non-exclusive, nonsublicensable, revocable license to display and reproduce the Coltcam Properties Content solely for your personal use in connection with using the Services.

3. Feedback

You may from time to time provide Coltcam Properties with suggestions, ideas, or other feedback regarding the Services ("Feedback"). Both parties agree that Coltcam Properties shall own such Feedback and is entitled, but not obligated, to use, develop and exploit it in any manner, without restriction or duty to compensate or seek permission from you.

4. Term and Termination

We reserve the right, in our sole discretion, to terminate your access to all or part of the Services, with or without notice. Upon termination, all rights granted to you in these Terms of Service will immediately cease. Any provision of these Terms of Service that expressly or by implication is intended to continue in force after termination will survive.

5. Indemnification

To the extent permitted by applicable law, you will defend, indemnify and hold harmless Coltcam Properties, its licensees, and their respective affiliates, parents, subsidiaries, officers, directors, agents, representatives, successors and assigns (the "Coltcam Properties Indemnitees") from and against all liability and expense, including without limitation reasonable counsel fees and costs, arising from any claim, suit or proceeding brought against a Coltcam Properties Indemnitee (i) claiming that Your Content infringes or misappropriates any proprietary right of any third party or (ii) in connection with your violation of these Terms of Service.

6. Disclaimer

THE SERVICES ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, RELIABILITY, AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL COLTCAM PROPERTIES OR ITS LICENSORS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES, EVEN IF COLTCAM PROPERTIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE TERMS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Corrections

The Services may contain errors or inaccuracies and may not be complete or current. Coltcam Properties reserves the right to correct any errors, inaccuracies, or omissions at any time without prior notice. We reserve the right to cancel or refuse to accept any order based on incorrect pricing or availability information.

8. Injunctive Relief

You agree that any breach of your obligations with respect to Coltcam Properties' proprietary or intellectual property rights will result in irreparable injury for which money damages are inadequate, and Coltcam Properties shall be entitled to seek injunctive relief, without the requirement of posting a bond, in addition to any other relief that a court may deem proper.

9. Copyright Claims

If you believe that your work has been copied in a way that constitutes copyright infringement, you may notify Coltcam Properties at 4620 Kennedale New Hope Rd, Fort Worth, TX 76140, by providing the following information:

• The signature of the owner of the copyright or the person authorized to act on the owner's behalf.
• A description of the copyrighted work that you claim has been infringed.
• Identification of the specific location on this website where the infringing material is located.
• Your name, address, telephone number, and email address.
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

10. Privacy Policy

10.1 General Privacy Practices

Coltcam Properties will process and store profile information that you provide (such as name, email address, and phone number) in accordance with this policy. Coltcam Properties may also send you service announcements, administrative messages, and other information in connection with your use of the Services. You may opt out of particular communications at any time.

Where access to the Services is provided through an institution's online learning management system using single sign-on (SSO), you consent to Coltcam Properties collecting your first and last name, institution, and course name from that institution, and disclosing personal information to your institution directly relevant to your use of the Services.

10.2 SMS / Text Messaging Policy

How to Opt In to SMS Communications

Coltcam Properties and its RV park properties offer SMS text messaging as a convenient way to communicate important information, including reservation confirmations, check-in reminders, maintenance updates, and promotional offers. You may opt in to receive SMS messages in any of the following ways:

• By texting a designated keyword (such as JOIN or YES) to our park's SMS number as displayed on our website, registration forms, or on-site signage.
• By completing a paper or digital registration or reservation form that includes an SMS opt-in checkbox and providing your mobile phone number.
• By verbally providing consent to a Coltcam Properties team member at the time of check-in or reservation, who will record your opt-in.
• By submitting an online contact or reservation form on any Coltcam Properties park website and checking the box to receive SMS communications.

Message frequency varies. Standard message and data rates may apply. You may receive up to approximately 4–8 messages per month per park property, depending on your stay and preferences.

How to Opt Out of SMS Communications

You may opt out of SMS communications at any time by:

• Replying STOP to any SMS message you receive from us.
• Contacting us directly at the RV park office or by emailing us at the address listed on our park's website.

After opting out, you will receive a single confirmation message and no further SMS messages will be sent, unless you choose to opt in again.

Non-Sharing of Mobile Opt-In Information

Mobile opt-in information, including your mobile phone number and SMS consent, will NOT be shared, sold, rented, or disclosed to any third party or affiliate for their own marketing or promotional purposes. This opt-in data is used solely by Coltcam Properties and its owned and operated RV park properties for the purpose of communicating with you directly about your reservation, stay, or park-related information.

Notwithstanding any other provision of this Privacy Policy that may reference data sharing with partners or affiliates, your mobile opt-in consent and phone number will never be used for third-party marketing purposes and will never be transferred to any outside organization for their independent use.

Types of SMS Messages You May Receive

Once opted in, you may receive SMS messages related to:

• Reservation confirmations, reminders, and updates.
• Check-in and check-out instructions.
• Maintenance or service notices relevant to your site.
• Park rules, weather alerts, or emergency notifications.
• Promotional offers, seasonal deals, or loyalty program updates (only if you have opted in to marketing communications).

10.3 General Data Practices

Coltcam Properties does not sell your personal information to third parties. Personal data collected through our websites and park operations is used to manage reservations, communicate with guests, improve our services, and comply with applicable laws. We may share data with trusted service providers who assist in operating our business (such as reservation platforms or payment processors), subject to confidentiality obligations and only as necessary to provide those services.

11. Miscellaneous

We make no representation that the Services are appropriate or available for use in your location, and accessing them from locations where their contents are illegal is prohibited. These Terms of Service represent the entire agreement between us and supersede any proposals or prior agreements, oral or written, relating to the subject matter hereof. We reserve the right, at our discretion, to update or revise these Terms of Service. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.

12. Notice for New Jersey Residents

Under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act ("TCCWNA"), N.J.S.A. 56:12-14 et seq., no provision of these Terms of Service shall apply to any consumer in New Jersey if the provision violates any clearly established legal right of that consumer.
